Background:
Personal data transferred outside the European Union (EU)/European Economic Area (EEA) still need to be adequately protected (Article 44 et seqq. GDPR). Contractual clauses approved by the EU Commission that provide appropriate data protection safeguards can be used as an instrument to ensure the protection of data transfers from the EU/EEA to third countries (Article 46(2)(c) GDPR).
In June 2021, the EU Commission issued revised SCCs for data transfers to third countries. Controllers or processors within the EU/EEA (or otherwise subject to the GDPR) may use these clauses when sending personal data for processing to controllers or processors outside the EU/EEA that are not subject to the GDPR. The new SCCs replace the previous sets of SCCs adopted under the previous Data Protection Directive 95/46.
As of 27 September 2021, contractual partners may only use this revised version to conclude SCCs. All previous standard contractual clauses that have already been agreed or are still agreed by 26 September 2021 will lose their validity on 27 December 2022 and must be replaced by the new SCCs by that date.
